Sorry, but both Tom and JayT were wrong: President Obama cannot suspend DADT by executive order because DADT is a law passed by Congress and signed by President Clinton. Only Congress can repeal—or suspend—DADT. If Obama tried, it would mean that he would be refusing to uphold the laws of the United States, and that’s unconstitutional. He can’t issue an executive order to stop investigations for the same reason. Only Congress can repeal laws, only Congress can stop spending money on investigations.
People are quick to blame Obama for the introduction and immediate withdrawal of the amendment to end investigations under DADT, and why? Because the author said that Democratic leaders and the White House pressured him. Has he offered proof of that, or are we supposed to accept him at his word? I don’t know that he doesn’t have an agenda of some sort, or that he wasn’t seeking attention. But people who are critical of Obama rushed to accept the Congressman’s word as gospel truth. I’m suspicious and cynical.
David was correct that the hold-up is the old military leaders who are opposed to repeal of DADT. Congress also has had a conservative majority for decades, and the last thing he wants to do is provoke Congress into passing something that’s even worse—that’s a mistake that Clinton made.
