Archerr, I agree with your reasoning on the firefighter case; if the test is fair and one doesn’t pass the test, then one shouldn’t get the test-mediated promotion. Also, the city’s actions were clearly intended to be discriminatory by favoring African-American candidates who didn’t pass the test.
